Ryan Darby was called to the bar in 1993.
Ryan's practice involves a broad range of general litigation and insurance defence matters with a particular emphasis on professional liability claims against accountants, financial planners, and design professionals and a focus on complex, multi-party litigation. Ryan has extensive trial experience at the British Columbia Supreme Court level. He has also appeared before the British Columbia Court of Appeal and the Supreme Court of Canada. His practice also includes appearances before administrative tribunals.
Ryan has prepared coverage opinions on many insurance matters including various directors’ and officers’ issues, and resolved claims involving allegations of fraud and negligence against accountants and financial services providers.
Ryan's previous work includes:
· negotiation and mediation of construction disputes involving architects, engineers and general contractors
· negotiation, mediation and litigation of financial cases including defence of accountants, financial planners and stockbrokers
· successful litigation defence of an architect regarding allegations of improper certification
· negotiations of and attendances at administrative hearings regarding professional discipline matters
· advice and negotiations regarding employment issues
· negotiations and resolution of defences involving geotechnical, environmental and land use issues
· negotiations and litigation of claims and defences relating to fires
· coverage advice, negotiations, mediations, and litigation regarding bad faith claims, directors’ and officers’ policies, fidelity policies, comprehensive general liability policies and all risk policies
· negotiation and successful litigation defences of product liability claims, occupiers liability claims and other claims involving significant personal injuries
Ryan has prepared papers on and given seminars regarding:
· directors' and officers' liability policies
· formal requirements for a proof of loss
· the Strata Property Act and its impact on insurance issues
· investigation of fire losses
· the law of misrepresentation as it relates to claims against accountants
· the effect of the Personal Information Protection and Electronic Document Act and its effect on claims handling procedures
· avoiding bad faith claims
